1. Acceptance of These Terms

By accessing or using Aligna Fitness (the “Site”) and/or purchasing any products or services (“Products”) from Aligna Fitness (“Aligna,” “we,” “us,” or “our”), you (“you,” “your,” or “Customer”) agree to be bound by these Terms of Service (the “Terms”) and our [Privacy Policy]. If you do not agree to all of the Terms, you may not access or use the Site or purchase Products.

2. Changes to the Terms

We may revise these Terms at any time by posting an updated version on the Site. The “Last updated” date above will reflect the effective date of the revised Terms. Continued use of the Site after any change constitutes acceptance of the updated Terms.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and capable of forming a binding contract under applicable law. By placing an order, you represent that you satisfy these requirements.

5. Product Information & Orders

All Product descriptions, images, pricing, and availability are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including errors or omissions in Product information or suspected fraudulent activity. If we cancel an order after payment has been processed, we will issue a full refund.

6. Pricing & Payment

Prices are listed in U.S. Dollars (USD) unless otherwise noted. Applicable taxes, duties, and shipping fees (if any) will be calculated at checkout. By submitting a payment method, you represent that you are authorized to use it and authorize us (or our third‑party payment processor) to charge the total amount of your order.

7. Shipping & Delivery

Shipping times provided at checkout are estimates only and not guaranteed. Title and risk of loss pass to you upon our delivery of the Products to the carrier. If a package is lost in transit, please contact us at alignabusiness@gmail.com so we can assist with a carrier investigation.

8. Returns & Refunds

If you are not satisfied with your purchase, please email alignabusiness@gmail.com within the timeframe stated on our Returns & Refunds Policy page. Returned Products must be unused, in original packaging, and accompanied by proof of purchase.

9. Intellectual Property

All content on the Site—including text, graphics, logos, photographs, videos, and software—is owned by or licensed to Aligna and protected by intellectual‑property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

10. User Content

You may submit reviews, comments, or other content (“User Content”) provided it is not illegal, obscene, threatening, or otherwise objectionable. By posting User Content, you grant Aligna a non‑exclusive, royalty‑free, worldwide, perpetual license to use, reproduce, modify, and display that content in any media.

11. Prohibited Uses

You agree not to:

• Violate any applicable law or regulation;
• Infringe any third‑party intellectual‑property or privacy rights;
• Engage in fraudulent, deceptive, or harmful conduct;
• Interfere with or disrupt the Site or servers.

12. Health & Safety Disclaimer

Aligna’s Products are intended for general fitness and wellness use. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified health professional before starting any exercise program. Use the Products as directed and at your own risk.

13. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALIGNA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALIGNA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless Aligna and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Site or Products.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict‑of‑law principles. You consent to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising out of or relating to these Terms or the Products.

17. Dispute Resolution

Before initiating legal action, please contact us at alignabusiness@gmail.com so we can attempt to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue formal remedies in the courts identified in Section 16.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and Aligna regarding the Site and Products and supersede all prior or contemporaneous communications.
